Terms of Sale

1. Purpose

These Terms of Sale define the conditions under which users purchase digital content offered by creators via the platform, as well as the terms of payment, Wallet management, deposits, withdrawals, and commissions.


2. Acceptance of the TOS

Acceptance of these Terms of Sale is mandatory:

  • when creating an account,

  • before any financial transaction.

Any paid use of the platform implies full and unconditional acceptance of the TOS and the Terms of Use (TOU).


3. Role of the platform

The platform acts solely as a technical and payment intermediary, in accordance with the TOU.

Accordingly :

  • it does not produce or sell content directly,

  • content is provided under the sole responsibility of the creators,

  • it collects payments on behalf of creators,

  • it transfers amounts due to creators after deducting its commission.

The platform is not responsible for the quality, compliance, or legality of content published by creators.


4. Digital content

The services offered on the platform consist of digital content and services made available online after payment, provided by creators under their sole responsibility.

Such content and services may include, but are not limited to:

  • subscriptions granting access to restricted areas or content,

  • pay-per-view (PPV) content,

  • paid messages, media, or interactions,

  • digital media (photos, videos, files),

  • crowfunding campaigns,

  • tips and virtual gifts,

  • digital or virtual products,

  • games, interactive wheels, or paid features,

  • access to paid public live streams,

  • access to private live streams,

  • paid audio or video calls.

Access to content and services is strictly personal, non-exclusive, and non-transferable.

The platform does not guarantee:

  • continuous availability of content or services,

  • duration of access,

  • permanence over time.

Creators may modify, interrupt, or delete any digital content or service at any time, including for technical reasons, without entitling users to a refund.

The platform is not responsible for:

  • the content provided,

  • the conduct of live interactions,

  • the quality or outcome of services offered by creators.


5. Prices and taxation

Prices of digital content and services are displayed in euros (€), VAT included (unless stated otherwise).

Applicable prices are those displayed at the time of transaction validation.

Taxes, including value-added tax (VAT) on digital services, are calculated according to applicable regulations and may vary depending on:

  • the user’s country of residence,

  • the type of service purchased,

  • the tax obligations applicable to the creator or the platform.

The platform acts as a payment intermediary and may collect and remit taxes in accordance with legal obligations.

Creators are free to set the prices of their content and services, subject to platform rules.

The platform reserves the right to:

  • modify its commissions,

  • adjust displayed prices,

  • correct any manifest pricing or calculation errors,

without creating a right to a refund for already validated transactions.

Any price change has no retroactive effect on already concluded transactions.


6. Payment

Payments on the platform follow this process:

  • Users can top up their Wallet via available methods, including:

    • credit/debit card,

    • any other available payment method.

  • All transactions for content, subscriptions, tips, and paid services (lives, calls, gifts, etc.) are debited from the Wallet.

  • All transactions are immediately due at the time of payment via the Wallet.

The platform reserves the right to refuse, suspend, or cancel any transaction in case of:

  • suspected fraud or abusive use,

  • violation of TOU or TOS,

  • technical incident or payment issue related to the Wallet top-up method.

Payments made to the Wallet are final, except in cases of manifest error or legal obligation.

The platform, acting as a payment intermediary, does not guarantee successful completion of every transaction or absence of delays from payment providers.


7. Wallet (Virtual Wallet)

7.1 Nature of the Wallet

The Wallet is an internal virtual wallet enabling :

  • users to pay for content, subscriptions, tips, and paid services,

  • creators to receive revenue from sales and interactions.

The Wallet :

  • is not a bank account and does not constitute a legal deposit instrument,

  • does not generate interest or financial yield,

  • can only be used within the platform for transactions defined in these TOS.

The platform acts as a payment intermediary and does not guarantee the success or continuous availability of each transaction.

7.2 Deposits
Users can credit their Wallet via available methods, including card, or any other occasional payment method.

Deposits are:

  • final and immediately available for internal platform transactions,

  • non-refundable except in case of legal obligation or manifest error,

  • not withdrawable by non-creator users,

  • may be blocked, suspended, or deferred for security checks, suspected fraud, or abnormal activity.

7.3 Use of funds
Funds in the Wallet may only be used for:

  • purchasing digital content, subscriptions, and creator services,

  • sending tips or virtual gifts,

  • participating in paid features (e.g., wheels, products, crowfunding campaigns, public/private lives, paid calls).

Fraudulent or non-compliant use may lead to:

  • temporary or permanent Wallet blocking,

  • platform sanctions (account suspension, transaction cancellation, fund withholding),

  • reporting to authorities if necessary.


8. Subscriptions

Subscriptions are concluded for a fixed duration set by the creator or the platform.

8.1 Automatic renewal
Unless canceled before expiration, subscriptions automatically renew for the same period. Renewal is paid via the Wallet. If the balance is insufficient, renewal may be suspended without platform liability.

8.2 Cancellation
Cancellation must occur before the end of the current period to avoid automatic renewal. No refund is granted for the current period, except in case of legal obligation or manifest platform error.

8.3 Modifications and interruptions
For technical or legal reasons, the platform or creator may:

  • modify subscription duration, price, or conditions,

  • temporarily suspend content access,

  • interrupt a subscription in exceptional cases (fraud, TOU/TOS violation).

No modification creates a refund entitlement or obligation for absolute continuity.

8.4 Abuse protection
The platform may suspend or cancel subscriptions in case of:

  • fraudulent or irregular activity,

  • TOU/TOS violations,

  • payment or Wallet issues.


9. Withdrawal right – Digital content and services

According to applicable consumer laws, users expressly acknowledge that:

  • immediate access to digital content/services (subscriptions, PPV, crowfunding campaigns, messages, media, tips, gifts, live streams, interactive features, calls) waives the withdrawal right,

  • no refund can be demanded once content or service is provided or access started, except for legal obligation or manifest error.

Using Wallet funds validates the purchase definitively; the platform is not responsible for withdrawal requests once service/content is delivered.

The platform may, at its discretion, offer partial or exceptional refunds only in cases of technical malfunction or manifest error.


10. Refunds and disputes

No refund is granted except for legal obligation, manifest error, or technical malfunction.

10.1 Payment dispute
In case of a transaction dispute or chargeback, the platform may:

  • suspend the user account,

  • block Wallet funds,

  • recover due amounts including commissions,

  • refuse new transactions until resolution.

10.2 Abuse protection
The platform may act against:

  • fraud or abusive Wallet use,

  • unauthorized or irregular transactions,

  • TOU/TOS violations.

It may freeze, cancel, or partially return funds as appropriate.

10.3 Liability limitation
The platform acts only as a payment intermediary and is not liable for:

  • payment disputes initiated with external providers,

  • delays or payment refusals due to providers,

  • temporary loss of access to content or services.


11. Creator revenue

Revenue from content/services is credited to the creator’s Wallet after platform commission.

11.1 Revenue adjustments
The platform may adjust Wallet funds in case of:

  • user dispute,

  • legal or exceptional refund,

  • chargeback,

  • verified fraud or abusive Wallet use.

Adjustments may include partial or total fund withholding until resolution.

11.2 Platform protection
The platform is not responsible for:

  • content provided by creators,

  • quality or compliance of paid services,

  • commercial disputes between users and creators.

It may suspend creator accounts for fraud, dispute, or TOU/TOS violations, freezing funds until resolution.

11.3 Transparency
Creators are informed of net amounts credited after commissions and adjustments.


12. Withdrawals

12.1 Eligibility
Withdrawals are reserved for verified creators. Conditions include:

  • minimum withdrawal threshold reached,

  • verified identity, banking or others,

  • completed KYC and regulatory checks.

Withdrawals are automatic per platform schedule.

12.2 Processing time
Processing time may vary by method and request volume and can be extended for:

  • security checks,

  • disputes,

  • chargebacks,

  • additional KYC verification.

Exact times are not guaranteed.

12.3 Refusal or cancellation
The platform may refuse, suspend, or cancel withdrawals for:

  • suspected fraud,

  • TOU/TOS violations,

  • unresolved transaction disputes,

  • incomplete KYC.

Blocked/adjusted funds are returned to the Wallet, with notification to the creator.

12.4 Security and responsibility
The platform is not liable for:

  • delays imposed by banks or payment providers,

  • withdrawal refusals for security/legal reasons,

  • fund use after transfer to chosen method.

13. Platform commission

The platform charges a commission on all transactions, including:

  • digital content purchases (PPV, subscriptions, paid messages/media),

  • tips and virtual gifts,

  • paid services (public/private lives, calls, interactive wheels, crowfunding campaigns),

  • any other digital content/service.

13.1 Commission rate
The rate may change at any time with reasonable notice. Changes apply only to transactions after the effective date.

13.2 Payment and Wallet integration
Commissions are automatically deducted from creator Wallet earnings. Net amounts are shown in the creator interface.

13.3 Non-refundable
Commissions are non-refundable, except for manifest error or legal obligation.

13.4 Abuse and dispute protection
The platform may withhold or adjust commissions for:

  • disputes,

  • chargebacks,

  • fraud or suspicious activity.

It is not liable for revenue loss due to these measures.


14. Account suspension and closure

The platform may suspend or permanently close accounts for:

  • TOU/TOS violations,

  • fraud or suspicious activity,

  • unresolved disputes,

  • abusive Wallet or platform use.

14.1 Fund blocking
Wallet funds may be :

  • temporarily blocked for checks or disputes,

  • adjusted for refunds, chargebacks, or proven fraud.

Users are notified via their interface.

14.2 Closure effects
Upon permanent closure :

  • access to content/services is removed,

  • Wallet funds temporarily held for legal/incident resolution,

  • remaining funds may be withdrawn per rules.

14.3 Platform protection
The platform acts only as a payment intermediary and is not liable for blocked or adjusted funds.


15. Liability

15.1 General limitation
Platform liability is strictly limited to commissions received for the transaction concerned.

The platform is not responsible for:

  • losses/damages from platform use,

  • access, quality, or content of digital services,

  • disputes between users and creators,

  • errors, delays, or unavailability from banks, or payment providers,

  • payment disputes or Wallet incidents.

15.2 Creator content
Creators are solely responsible for their content and services. The platform guarantees neither accuracy, quality, nor compliance.

15.3 Abuse protection
The platform may suspend/adjust any account, transaction, or fund in case of:

  • proven fraud or suspicious activity,

  • TOU/TOS violation,

  • dispute or payment issue.

Liability never exceeds commissions received.


16. Applicable law

These Terms of Sale are governed by the law of the country where Addikme is domiciled.

Disputes concerning transactions, payments, Wallet, subscriptions, or paid services will be treated under the TOU and applicable law.

Users are encouraged to consult the TOU for details on:

  • dispute resolution,

  • competent jurisdiction,

  • legal restrictions by country,

  • obligations for content, and paid services.
