General Terms of Use

1. Introduction

These General Terms of Use (GTU) govern access to and use of the services offered under the Addikme brand by the company Mananeo, whose registered office is located at 254 Rue Vendôme, 69003 Lyon, France (hereinafter “Addikme”, “the Platform” or “the Merchant”). By registering on the Platform and using our services, you expressly agree to these GTU.

If you do not agree with these terms, you must not use Addikme’s services.

These GTU constitute a legally binding agreement between the User (Fan), the Creator or the Ambassador, on the one hand, and Addikme, in its capacity as Merchant, on the other hand.


2. Acceptance of the GTU

Acceptance of these GTU is mandatory:

  • when creating an account
  • when any update requires renewed acceptance
  • to continue using the services and features offered by Addikme

By creating an account or using the Platform, the User or Creator acknowledges having read these GTU and fully agrees to them.

When paid services are used, the applicable General Terms and Conditions of Sale (GTC) must also be accepted.


3. Registration and account creation

3.1. User (Fan)

To access the services, you must create an account:

  • You agree to provide accurate, complete and up-to-date information.
  • You must maintain the confidentiality of your login credentials and take the reasonable measures necessary to secure your account.
  • You must immediately inform us of any unauthorized use of your account.
  • Access is restricted to Users aged 18 or over.
  • The User acknowledges that under no circumstances may they claim a right to a refund in the event of suspension or termination related to a breach of these GTU.
  • Any failure to comply with your obligations or any breach of the GTU may result in the suspension or termination of your account as well as the application of the measures provided for in these GTU concerning the amounts held in the wallet.

3.2. Creator

To publish content and receive payments:

  • You must create an account and provide complete personal and banking information.
  • You must complete KYC verification in order to certify your Creator status.
  • You agree to publish only lawful, consensual content that complies with these GTU and warrant that you hold all rights, authorizations and consents necessary for its publication and distribution on Addikme.
  • Access is restricted to persons aged 18 or over.
  • Any failure to comply with your obligations or any breach of the GTU may result in the suspension or termination of your Creator account as well as the application of the measures provided for in these GTU concerning earnings or amounts held in the wallet.

4. Access to the Platform

Access to the Platform is restricted to Users aged 18 or over.

By accessing the Platform, you confirm that you have reached the legal age required in your country of residence to use our services.

All Users and Creators must complete the age verification step through the age verification provider used by Addikme.

This step is intended in particular to:

  • ensure access to adult-only content
  • comply with applicable legal requirements
  • secure the use of the Platform

Until age verification has been successfully completed, full access to the Platform and certain features may be restricted.

4.1. Verifications, checks and security measures

Addikme may carry out additional checks and verifications at any time, particularly where there is reasonable doubt concerning:

  • the actual age of a User or Creator
  • the accuracy, consistency or truthfulness of the information provided
  • the identity, behavior or activity of an account
  • compliance with these GTU and applicable laws
  • any suspicious, fraudulent or abusive use of the Platform

4.2. Nature of the verifications

These checks may include, without limitation:

  • requests for additional documents relating in particular to identity, age or personal information
  • enhanced identity or age verifications through the providers used by Addikme
  • manual or automated analyses of account activity, content or transactions

4.3. Measures applicable in the event of doubt or non-compliance

In the event of reasonable doubt, inconsistency, false declaration, suspicious activity or non-compliance with these GTU, Addikme may in particular:

  • temporarily restrict access to the account
  • suspend the account
  • block all or part of the features, including:
    • payments
    • deposits
    • withdrawals
    • access to the wallet
  • permanently terminate the account

These measures may be taken without prior notice when necessary to ensure the security of Users, Creators, the Platform or compliance with applicable obligations.

4.4. Consequences of suspension or termination

In the event of suspension or termination related to a breach, fraud or compliance procedure, the amounts, earnings or transactions concerned may be blocked, cancelled or processed in accordance with these GTU and applicable obligations.

Addikme cooperates with the competent authorities and communicates legally required information when such cooperation or communication is required by applicable law, a court decision or a request from a competent authority.

5. Prohibited content

Any content prohibited by law, even if not explicitly listed below, is strictly prohibited.

It is strictly prohibited to publish or share any content on Addikme that is:

  • Illegal:

    ```

    • Child pornography or any form of sexual exploitation of minors. This type of content is not only illegal but also entirely unacceptable.

    • Incestuous content involving actual sexual relations between members of the same close family, where prohibited by law or involving identifiable or non-consenting persons.

    • Content inciting violence, racial, religious or sexual hatred, or any form of discrimination. This includes hate speech and attacks targeting a race, religion, sexual orientation or any other characteristic protected by applicable laws.

    • Content relating to criminal activities, including but not limited to fraud, theft, scams, or incitement to illegal acts.

    • Content exploiting or humiliating individuals in a non-consensual or abusive manner. This includes videos, images or recordings in which persons are shown in a compromising or humiliating situation without their explicit consent.

    • Content depicting or suggesting acts of necrophilia, in any form whatsoever. Any content involving deceased persons in a sexual or erotic context is strictly prohibited.

  • Non-consensual:

    • Any content involving persons who do not explicitly consent to their participation or to the recording of their images, videos or performances.

    • Non-consensual acts, whether physical or psychological, shown in content published on the Platform.

    • Any content based on false consent, manipulation, coercion or deception.

    • The use of deepfakes, artificial intelligence or editing intended to make a person appear in a sexual context without their consent.

    • The modification, alteration or reconstruction of images, videos or voices for sexual purposes without the explicit authorization of the person concerned.

    • Any content depicting or suggesting rape, coercion, the use of force or sexual activity involving a person incapable of consenting is strictly prohibited, particularly where that person is asleep, unconscious, fainted, hypnotized, drunk, drugged, intoxicated or under the influence of any substance impairing their ability to consent.

    • Any person in a condition that does not allow them to give free, informed and voluntary consent is considered incapable of consenting. Any content involving such a situation constitutes a breach of these GTU and the rules of the Platform.

  • Violence  :

    • Any form of content depicting or promoting acts of gratuitous violence, torture or physical or psychological abuse.

    • Exploitation of suffering, whether emotional, physical or psychological, for profit or for shock value.

  • Harm to animals:

    • Any content involving animals in a sexual or erotic context is strictly prohibited.

    • Zoophilia or bestiality, in any form whatsoever.

    • Any depiction, staging or suggestion of sexual acts between a human and an animal. This type of content is strictly prohibited on Addikme.

  • Scatology and degrading behavior:

    • Scatological content, including fecal elements or any other content that may be considered degrading, dirty or inappropriate. This type of content is strictly prohibited on Addikme.

    • Degrading behavior or practices in which individuals are forced or encouraged to participate in acts that violate their human dignity.

  • Intellectual property:

    • Infringement of copyright or intellectual property rights of other creators. This includes, but is not limited to, the unauthorized reproduction of videos, images, music, logos or works belonging to third parties without their explicit consent.

    • Content using trademarks, logos or protected elements subject to copyright without authorization, whether graphic, audio or video elements.

  • Fraudulent or malicious behavior:

    • Any attempt at fraud, scamming or manipulation of the Platform, whether through the use of false information, falsified data, or by impersonating other Users or the Platform.

    • Sexual or personal identity theft, including creating fake profiles, using the identity of a third party, or distributing sexual content under a false identity or without authorization.

    • Attempted hacking of User accounts or the Platform system for the purpose of stealing information or altering data.

  • Other unacceptable behavior:

    • Exploitation of Users, by manipulating, harassing or encouraging them to perform non-consensual acts. This also includes attempts to scam or manipulate the audience for the purpose of exploiting them.

    • Distribution of content for adultery, non-consensual content, or content that does not respect the rights of others. Any content intended to exploit or abusively manipulate other members of the community will be immediately removed and may result in account suspension.

This list is not exhaustive. Addikme monitors and moderates content distributed on the Platform in accordance with these GTU and applicable compliance rules. Any content identified as prohibited, illegal, non-consensual or contrary to these GTU is blocked, removed or subjected to additional verification depending on the nature of the situation. Any breach of these rules may result in the suspension or termination of the account concerned as well as the removal of the problematic content.


6. Prohibited behavior

It is prohibited in particular:

  • to engage in any form of harassment, intimidation, threat, manipulation or abuse
  • to commit or attempt to commit fraud, a scam or manipulation of the Platform
  • to engage in any malicious behavior aimed in particular at unlawfully obtaining personal, professional or confidential information concerning other Users or Creators


7. Prevention of exploitation and human trafficking

Addikme applies a zero-tolerance policy regarding any form of exploitation, human trafficking, modern slavery, forced labor, coercion or sexual exploitation.

Any content, behavior or activity that may fall within such practices is strictly prohibited on the Platform and may result in the removal of the content concerned, suspension or termination of the account and, where necessary, reporting to the competent authorities.

8. Content control, moderation and responsibility

Addikme implements control and moderation procedures intended to ensure that the content and activities offered on the Platform comply with these General Terms, the Platform rules and applicable legal and regulatory provisions.

8.1. Control of published content

Content submitted for publication on Addikme, including photos, videos, posts, stories, reels, paid content and other media uploaded by Creators, is subject to control and moderation procedures that may in particular rely on automated detection systems and, where necessary, additional verification by Addikme’s moderation team, in accordance with the compliance rules applicable to Addikme.

Content identified as potentially contrary to these General Terms, the Platform rules or applicable law may be blocked, subjected to additional verification or rejected before publication.

Addikme implements measures intended in particular to detect and prevent the publication of prohibited, illegal, non-consensual content or content contrary to these General Terms.

However, validation of content by Addikme’s systems or moderation teams does not constitute recognition of its legality by a competent authority and does not exempt Users or Creators from complying with the obligations and guarantees provided for in these GTU.

8.2. Messages, chats, calls and live streams

The Platform rules also apply to the communications and interactive services offered by Addikme, including:

  • private messages and chats
  • audio calls
  • video calls
  • public live streams
  • private live streams
  • and, more generally, any feature allowing real-time exchanges or broadcasts

Addikme implements moderation, reporting and intervention measures adapted to the nature of these features, while respecting Users’ privacy and the confidentiality of their communications.

Publicly accessible content and broadcasts may be subject to control and moderation measures intended to ensure compliance with these General Terms and the Platform rules.

Private communications are not subject to systematic human monitoring by Addikme. However, when content, a communication or behavior is reported, when a breach of these General Terms is detected or when intervention is required by law, Addikme may carry out the necessary verifications and take appropriate measures.

When prohibited or potentially illegal content or behavior is detected or reported, Addikme may in particular block or make the content concerned inaccessible, interrupt a broadcast or interactive service and initiate the necessary verifications.

8.3. Obligations of Creators and Users

Each Creator or User agrees to submit and distribute only lawful, consensual content that complies with these GTU.

They warrant in particular:

  • that they are legally authorized to publish or distribute the content concerned
  • that they hold all necessary rights, authorizations and consents
  • that all persons depicted are adults where required
  • that the content and activities are lawful and consensual
  • that they comply with these General Terms and the Platform rules

It is strictly prohibited to attempt to circumvent Addikme’s control or moderation systems.

8.4. Moderation by Addikme

Addikme ensures the implementation and operation of its control and moderation procedures in accordance with the obligations applicable to it as operator of the Platform.

The obligations and guarantees imposed on Creators and Users by these GTU, particularly regarding rights, authorizations, consent and compliance with the Platform rules, constitute conditions of use of Addikme.

8.5. Reporting and cooperation with authorities

Any User or Creator may report content or behavior that may be illegal or contrary to the Platform rules using the reporting tools and contact methods provided by Addikme.

When Addikme becomes aware of content or activity that may constitute an offense requiring reporting or cooperation with the competent authorities, Addikme applies the procedures provided for by applicable law.

Addikme may in particular retain and transmit to the competent authorities information whose retention or disclosure is legally required.

8.6. Development of moderation systems

Control and moderation procedures and measures may evolve in order to take into account in particular:

  • legal and regulatory developments
  • the requirements of payment partners and service providers
  • new features offered on the Platform
  • developments in techniques for detecting and preventing prohibited content
  • risks identified for Users, Creators or the Platform


9. Complaints, reports and contact

Addikme provides Users, Creators and any person appearing in content distributed on the Platform with means to submit a complaint or report content, an account, behavior or activity that may breach these GTU, the Platform rules or applicable law.

A person depicted in content may in particular contact Addikme if they believe that the content was published or distributed without their consent or without valid authorization.

Reports may be made:

Reports concerning in particular potentially illegal or non-consensual content or content likely to cause serious harm to a person are handled as a priority by Addikme.

When illegal content or content distributed without the required consent is reported, Addikme takes the necessary measures to remove it or prevent access to it within a maximum period of 24 hours from receipt of the report.

All other complaints are reviewed fairly and consistently, with the objective of reaching, where possible, a satisfactory resolution for the complainant within a maximum period of five (5) days.

Depending on the nature of the complaint or report, Addikme may in particular request additional information, carry out the necessary verifications, temporarily make content inaccessible or remove it, restrict a feature or take any other appropriate measure in accordance with these GTU.

10. Ownership of content

Content published on Addikme remains the property of its respective owners, including texts, photos, videos, audio, files, private messages, paid content, stories, reels, products, fundraising campaigns and other content offered on the Platform.

By publishing content on the Platform, the relevant owner grants Addikme a worldwide, non-exclusive, royalty-free and transferable license allowing Addikme to use, reproduce, adapt, distribute and display such content as part of Addikme services, including in particular:

  • its distribution on the Platform and its related services
  • the promotion and advertising of the content or the Platform
  • its display on other media related to Addikme

This license does not affect the intellectual property rights of the relevant owner. Addikme undertakes not to sell or exploit such content outside the scope provided for by the Platform without authorization where such authorization is required.


11. Visuals, illustrations and content generated or assisted by artificial intelligence

Addikme may use, on its public pages, blog, help pages, communication materials, presentation interfaces or any other section intended to present the Platform, images, illustrations, banners, icons, marketing visuals, graphic content or visual elements created, generated, retouched, enhanced or assisted using digital tools, including artificial intelligence tools.

These visuals are intended exclusively for illustrative, aesthetic, informative, promotional or educational purposes.

Unless expressly stated otherwise, these visuals are non-contractual. They do not constitute an exact, guaranteed or exhaustive representation of the content, profiles, Creators, Users, services, features, prices, earnings, results, performance, interactions, availability or experiences actually accessible on the Platform.

The content, profiles, services, prices, features and conditions actually applicable are those displayed in the Platform interface, on the relevant pages, in these GTU and, where applicable, in the specific terms applicable to certain services.

Any use of visuals generated, retouched or assisted by artificial intelligence does not alter the rights, obligations, guarantees or responsibilities provided for in these GTU


12. Liability

Addikme, in its capacity as Merchant in relation to its payment service providers, assumes the monitoring, compliance and moderation obligations incumbent upon it with respect to the content and activities offered on the Platform, in accordance with the legal, regulatory and contractual obligations applicable to it.

In this respect, Addikme implements the necessary measures to ensure the operation, security, monitoring and moderation of the Platform.

Each User and Creator remains responsible for the content, information and activities they submit, publish, transmit or distribute on the Platform, as well as for compliance with the rights, authorizations, consents and obligations applicable to them.

The obligations assumed by Addikme in its capacity as Merchant shall under no circumstances release Users and Creators from their obligation to comply with these General Terms and Conditions, the Platform rules, and the laws and regulations applicable to their use of Addikme services.

The content and activities concerned include, in particular, texts, photos, videos, audio content, files, messages, paid content, stories, reels, products, fundraising campaigns, audio calls, video calls, public live streams, private live streams, as well as any other functionality offered on the Platform.

The obligations imposed on Users (Fans), Creators and Ambassadors under these Terms and Conditions, the Platform rules or applicable law remain their own and are not transferred to Addikme solely as a result of the monitoring, verification, security or moderation measures implemented by the Platform.

12.1. Obligations relating to content and activities

By using Addikme, Users and Creators agree in particular to:

  • publish, transmit or distribute only content authorized by these GTU and the Platform rules
  • respect the rights of third parties, including intellectual property rights, image rights and privacy
  • hold the necessary rights, authorizations and consents relating to the content they submit to the Platform
  • not publish or distribute illegal, prohibited, fraudulent or non-consensual content
  • provide accurate, complete and up-to-date information when requested by Addikme
  • comply with the control, security and moderation procedures implemented by Addikme
  • not attempt to circumvent or compromise the Platform’s security or control systems

When content depicts or involves another person, the Creator warrants that they have obtained the authorizations and consents necessary for that person’s participation, recording and distribution of the content, as well as the required supporting documents where applicable.

12.2. Measures taken by Addikme

Where content, activity or behavior may breach these GTU, the Platform rules, third-party rights or applicable law, Addikme may carry out the necessary verifications and take any appropriate measure.

These measures may include in particular:

  • blocking or removing the content concerned
  • requesting additional information or supporting documents
  • restricting certain features
  • interrupting a service or broadcast
  • temporarily suspending the account
  • terminating the account in the event of a serious or repeated breach
  • temporarily blocking certain transactions or amounts during the necessary verifications
  • any other measure provided for in these GTU or necessary to comply with the obligations applicable to Addikme

12.3. Users (Fans)

Users must use the features offered by Addikme in accordance with these GTU and the Platform rules.

This includes in particular messages, comments, reviews, interactions, purchases, tips, payments and any other content or behavior carried out from their account.

In the event of a breach of these GTU, the Platform rules or applicable laws, Addikme may take the necessary measures concerning the relevant content, activity or account.

12.4. Creators

Creators agree that the content and services they offer on Addikme will comply with these GTU, the Platform rules and applicable obligations.

They warrant in particular that they hold the necessary rights, authorizations, consents and supporting documents relating to the content they wish to publish or distribute.

Earnings generated through the Platform are subject to compliance with these GTU as well as applicable security, payment and compliance checks.

When a breach, anomaly or situation requiring verification is detected, Addikme may take the measures provided for in these GTU concerning the content, account or amounts concerned.

12.5. Use of the account and wallet

Each User and Creator must take reasonable measures to preserve the security of their account, login credentials and means of access.

Any unauthorized use, account compromise, suspicious transaction or anomaly must be reported to Addikme as soon as possible so that the necessary verifications and security measures can be implemented.

Addikme implements the necessary security and protection measures falling within its own obligations concerning the Platform and the services it provides.

12.6. Payments and external service providers

Certain Addikme features rely on external service providers, particularly for payments, deposits, withdrawals, identity verification, age verification, hosting or certain technical services.

Addikme monitors and manages the services within its scope and cooperates with its service providers where necessary for the processing of a transaction, incident or request.

Timeframes, procedures, verifications or fees directly applied by an external service provider may depend on that provider’s own terms.

12.7. Operation of the Platform

Addikme implements the necessary means to ensure the availability, security and proper operation of the Platform and intervenes when an incident falling within its services is identified.

Certain temporary interruptions or limitations may nevertheless occur, in particular due to maintenance operations, updates, technical incidents, security measures or the temporary unavailability of a third-party service.

In such situations, Addikme takes the appropriate measures falling within its obligations in order to restore or secure the services concerned.

12.8. Duty to report and cooperate

Users and Creators must report to Addikme as soon as possible any suspicious activity, unauthorized use, potentially prohibited content or incident of which they become aware on the Platform.

Addikme may carry out the necessary verifications, take appropriate measures and, where required by law, cooperate with the competent authorities or bodies.

Addikme provides a Platform allowing in particular the publication and distribution of content, interactions between Users and Creators, and access to various services and features.

Addikme does not provide any financial, tax or investment advice.


13. Compliance with the GTU and applicable laws

By using the Addikme Platform, Users and Creators agree to comply with:

  • these General Terms of Use
  • all laws and regulations applicable to them

13.1. Compliance with legal obligations

In connection with their use of the Platform, Users and Creators agree to comply with the obligations applicable to them concerning in particular:

  • the content they submit, publish, distribute or market
  • the legal compliance of their activities on the Platform
  • the protection of minors
  • consent
  • intellectual property
  • personal data protection
  • applicable tax and social security rules
  • laws governing adult content

These commitments constitute conditions of use of the Platform.

13.2. Legal differences between countries

Users and Creators acknowledge that certain practices, content or services may be permitted in one country and prohibited in another.

It is their responsibility to ensure that their use of the Platform and their activities comply with the laws applicable to them.

Addikme implements the measures falling within its own legal, regulatory and contractual obligations applicable to the operation of the Platform.

13.3. Cooperation with authorities

Addikme may:

  • cooperate with the competent authorities where required by law
  • provide legally required information in connection with investigations, court decisions, official requests or regulatory obligations

13.4. Sanctions in the event of non-compliance

Any breach of these GTU or applicable laws may result, depending on the nature and seriousness of the breach, in:

  • removal or blocking of the content concerned
  • restriction of certain features
  • suspension or termination of the account
  • application of the measures provided for in these GTU concerning earnings or amounts held in the wallet


14. Withdrawals

For Creators, the withdrawal of earnings is subject to certain conditions:

  • Verified account : the Creator account must have completed the required KYC checks.
  • Minimum balance : 50 € or the equivalent in the applicable currency.
  • Payment method : bank transfer or any other available payment option.
  • Fees and commissions :
    • depending on the selected method, processing, network or conversion fees may apply
    • applicable fees and commissions are displayed before the transaction is confirmed
  • Payment period : according to the options available on the Platform.
  • Processing times : they may vary depending on the selected payment method.
  • Security and verification : automatic or manual checks may be carried out to protect funds and comply with compliance obligations.

Addikme may delay or temporarily suspend a withdrawal when security or compliance checks are required.

14.1. Accuracy of payment information

The Creator is responsible for the accuracy and updating of the information they provide to receive payments, including their bank details and account holder information.

If incorrect, incomplete or inaccurate information provided by the Creator results in the rejection, return, cancellation or failure of a payment, the fees actually charged to Addikme by its payment provider or the financial institution concerned as a direct consequence of this error shall be borne by the Creator.

These fees may be deducted from the Creator’s available balance, from the amount of the payment concerned or, where necessary, from a subsequent payment.

No fees will be charged to the Creator when the incident results from an error attributable to Addikme or its payment provider.

15. Deposits

To fund a wallet on the Platform:

  • Active account : the account must be active and not suspended.
  • Age verification : the verifications required by Addikme must have been completed.
  • Minimum and maximum amount : minimum 20 € and maximum 400 €, subject to the limits applicable to the payment method used.
  • Accepted payment methods : bank card or any other payment option offered on the Platform.
  • Transaction fees : any applicable fees are displayed before payment is confirmed.
  • Payment security : payments are processed using the providers and security procedures used by Addikme.
  • Processing times : they may vary depending on the payment method or provider concerned.

16. Fundraising campaigns

16.1. Purpose of fundraising campaigns

Addikme allows Creators to publish fundraising campaigns in order to present a project, need or objective and receive voluntary support from Users of the Platform.

Contributions made as part of a campaign are considered donations intended to support the Creator and the project they present.

They do not constitute an investment, a loan or the acquisition of a financial interest and do not entitle the contributor to any interest, return, financial benefit or ownership right in the Creator’s project.

16.2. Funding target

The Creator may set a target amount for their campaign.

This target is presented for informational purposes in order to inform Users of the amount the Creator wishes to raise.

The campaign is not based on a funding system conditional upon reaching the target.

Consequently, if the target amount is not reached, contributions already received remain valid and may be paid out in accordance with the conditions applicable to earnings and withdrawals.

Failure to reach the target therefore does not automatically entitle contributors to a refund.

16.3. Creator obligations relating to their campaign

The Creator guarantees the accuracy, truthfulness, legality and compliance of the information, descriptions, images, objectives, commitments and statements they submit as part of their campaign.

They also guarantee that they hold all necessary rights, authorizations and consents relating to the content used in their campaign.

The Creator agrees in particular to:

  • present their campaign clearly, truthfully and in sufficient detail
  • provide accurate, fair and non-misleading information
  • not mislead Users regarding the nature, objective or intended use of the funds
  • use the funds received in accordance with the purpose announced in the campaign
  • inform contributors of any significant change concerning the project
  • honor the commitments presented as part of the campaign
  • comply with these GTU and all laws applicable to them

The campaign remains subject to the control and moderation procedures implemented by Addikme before publication and while it is present on the Platform.

16.4. Prohibited campaigns

It is prohibited in particular to create or publish a campaign:

  • with an illegal, fraudulent, misleading purpose or one contrary to these GTU
  • based on false, incomplete or potentially misleading information
  • intended to finance an activity, product, service or content prohibited on Addikme
  • infringing the rights, security or privacy of a third party
  • using the identity, image, content or intellectual property of a third party without authorization
  • intended to circumvent the Platform’s payment, withdrawal or commission rules
  • intended to artificially generate transactions, earnings or benefits
  • presenting a risk of fraud, money laundering or scamming
  • containing false or misleading promises
  • requesting contributions outside the official payment methods offered by Addikme
  • encouraging contributors to continue payments or financial exchanges outside the Platform

This list is not exhaustive. Addikme may consider prohibited any campaign presenting a risk to Users, Creators, third parties or the Platform.

16.5. Verification, suspension and cancellation of a campaign

Addikme may review a campaign before or after publication.

In the event of doubt, a report, a dispute, non-compliance with these GTU or an identified risk, Addikme may in particular:

  • request additional information or supporting documents
  • temporarily hide the campaign
  • suspend the collection of contributions
  • temporarily block the funds concerned
  • request the modification or removal of certain elements
  • permanently cancel the campaign

16.6. Cancellation and refund of contributions

Failure to reach the funding target does not, by itself, constitute grounds for cancellation or refund.

Contributions may be refunded when Addikme decides to cancel a campaign, in particular due to:

  • a breach of these GTU
  • false, misleading or fraudulent information
  • a prohibited or illegal purpose
  • a risk of fraud or abuse
  • an infringement of the rights or security of a third party
  • misuse of the campaign system
  • any other serious breach of the Platform rules

Where Addikme decides to cancel a campaign, the contributions concerned may be recredited in accordance with the procedures applicable on the Platform.

16.7. Availability of funds

Contributions received as part of a campaign may remain temporarily pending during security, compliance or validation checks carried out by Addikme.

Provided that the campaign is not suspended or cancelled, the funds collected become available in accordance with the rules applicable to earnings and withdrawals.

16.8. Addikme’s role in campaigns

Addikme provides the technical features allowing Creators to present a campaign and Users to contribute to it.

Addikme controls and moderates campaigns in accordance with these GTU and the obligations applicable to the Platform.

However, Addikme does not guarantee:

  • that the financial target of a campaign will be reached
  • that the project presented will actually be completed
  • that the announced deadlines will be met
  • that the outcome of the project will meet contributors’ expectations

16.9. Fees and commissions

Contributions and earnings from campaigns are subject to the fees, commissions and processing rules applicable on Addikme.

The information in force is displayed on the Platform or in the relevant areas before transactions are confirmed.

16.10. Fraud and sanctions

Any fraudulent or abusive use of the campaign system may in particular result in:

  • cancellation of the campaign
  • refund of contributors
  • blocking or cancellation of the funds collected
  • suspension or termination of the account concerned
  • removal of the content concerned
  • any other measure necessary to protect the Platform and its Users

Addikme may communicate to payment providers the information necessary for fraud prevention, security and transaction compliance within the limits provided for by applicable law.


17. Ambassador Program

17.1. Purpose of the program

The Addikme Ambassador Program allows persons with an Ambassador account to recommend Addikme to new Creators and Fans and receive commissions when the Users referred in this way generate eligible activity on the Platform.

Registration for the Ambassador Program is free of charge and strictly reserved for persons aged 18 or over.

17.2. Attribution of a Fan or Creator to an Ambassador

To qualify for a commission, the Fan or Creator must have been correctly attributed to the Ambassador by means of a tracked link, a campaign or any other attribution system made available by Addikme.

Unless otherwise expressly provided by Addikme, a User who already had an account before attribution cannot be retroactively linked to an Ambassador.

17.3. Commissions on referred Creators

When a Creator attributed to an Ambassador meets the program’s eligibility conditions, the Ambassador may receive a commission calculated on the eligible earnings actually due to the Creator after deduction of Addikme’s platform commission.

The standard scale is:

  • 10% during the first twelve (12) months
  • 5% during the following twelve (12) months
  • 2% during the following twelve (12) months

Compensation relating to the same Creator ends as soon as one of the following limits is reached: 50,000 € in cumulative commissions or thirty-six (36) months from the date of attribution to the Ambassador.

17.4. Commissions on referred Fans

When a Fan attributed to an Ambassador makes eligible and validated deposits on Addikme, the Ambassador may receive a commission calculated according to the following standard scale:

  • 5% during the first twelve (12) months
  • 2% during the following twelve (12) months

Compensation relating to the same Fan is limited to twenty-four (24) months from the date of attribution to the Ambassador.

The basis used to calculate commissions is capped at 100 € of eligible deposits per Fan over any rolling period of twenty-four (24) hours.

17.5. Eligible activities and transactions

Only activities or transactions considered eligible by Addikme may generate a commission.

A cancelled, refunded, fraudulent, disputed transaction or a transaction subject to a chargeback may be excluded from the calculation of commissions.

17.6. Status and validation of commissions

Commissions may in particular appear as:

  • generated
  • pending
  • available
  • paid
  • cancelled or adjusted

A generated commission is not necessarily immediately available for withdrawal.

Addikme may apply a validation period allowing it in particular to take into account refunds, cancellations, chargebacks or anti-fraud checks.

17.7. No impact on referred Users

Commissions paid to the Ambassador do not result in any specific reduction in the rights, benefits or features normally granted to the referred Fan or Creator.

17.8. Attribution disputes

In the event of an attribution dispute concerning a Fan, Creator or transaction, Addikme applies the attribution rules in force in order to determine the Ambassador to whom the commission is due.

17.9. Ambassador verification and payment of commissions

An Ambassador may begin using certain Program features and generating commissions before completing all required verification procedures.

However, no withdrawal or payment of commissions may be made before the verifications required by Addikme have been fully completed and approved.

Addikme may in particular request:

  • identity verification (KYC);

  • verification of the company or professional activity (KYB), where applicable;

  • information concerning the legal representative;

  • the required tax information;

  • validation of a payment method;

  • any document reasonably necessary to comply with applicable legal, regulatory, tax, contractual or compliance obligations.

Commissions generated before the verifications have been fully approved are recorded on a provisional basis and only become earned and payable after approval of the required verifications.

If a verification is refused, the Ambassador may be asked to provide additional information or documents or to correct the elements that led to the refusal.

In the event of a final refusal of KYC, KYB where applicable, or any other mandatory verification, in particular due to the inability to verify the Ambassador’s identity, invalid or falsified documents, false information, fraud, prohibited activity or any other situation that legally or regulatorily prevents Addikme from making a payment, no payment will be made and the provisional commissions concerned will not be earned and may be cancelled.

The minimum amount required to request a withdrawal is set at 100 € of available and definitively earned commissions.

Accuracy of payment information

The Ambassador is responsible for the accuracy and updating of the information provided to receive payment of their commissions, including bank details and account holder information.

If incorrect, incomplete or inaccurate information provided by the Ambassador results in the rejection, return, cancellation or failure of a payment, the fees actually charged to Addikme by its payment provider or the financial institution concerned as a direct consequence of this error shall be borne by the Ambassador.

These fees may be deducted from available commissions, from the amount of the payment concerned or, where necessary, from a subsequent payment.

No fees will be charged to the Ambassador when the incident results from an error attributable to Addikme or its payment provider.

17.10. Abuse, fraud and prohibited practices

It is strictly prohibited to create, use or manipulate accounts, registrations, transactions, clicks or campaigns in order to artificially generate commissions.

The following are prohibited in particular:

  • multiple, fictitious or fraudulent accounts
  • direct or indirect self-referral
  • artificial manipulation of deposits or transactions
  • splitting intended to circumvent caps
  • unauthorized use of third-party data, identities or payment methods
  • any attempt to manipulate tracking or attribution systems
  • artificial generation of clicks, registrations or conversions
  • spam or misleading practices

17.11. Suspension, cancellation and sanctions

In the event of fraud, attempted fraud, abuse or breach of these terms, Addikme may in particular:

  • temporarily suspend the validation or payment of commissions
  • cancel commissions obtained improperly
  • make adjustments
  • request supporting documents
  • suspend or close the Ambassador account
  • remove access to the Ambassador Program

17.12. Development of the Ambassador Program

Addikme may change the rates, durations, caps, eligible activities and other terms of the Ambassador Program.

Unless required by law, for security reasons or as a measure related to fraud or compliance, new commercial terms apply to new attributions made after they enter into force.

Addikme may also agree on specific terms with certain Ambassadors or professional partners.

17.13. Access to and monitoring of the Ambassador Program

The Ambassador may view available information concerning their network, campaigns, performance, conversions and commissions from their Ambassador dashboard.

Access to the dashboard requires being logged into an Ambassador account. When an Ambassador is not logged in, they are prompted to log in to their account before being able to access their dashboard.

18. Changes to the GTU

Addikme may amend, update or supplement these GTU in particular in order to:

  • comply with legal or regulatory developments
  • improve the Platform and its features
  • strengthen security, compliance or the protection of Users and the Platform

18.1. Entry into force of changes

Amended GTU enter into force:

  • upon their publication on the Platform
  • or on the date indicated in the update notification, where applicable

A notice may in particular be communicated by:

  • notification on the Platform
  • email
  • message when logging into the account

18.2. Acceptance of the new GTU

Continued use of the Platform after the updated GTU enter into force constitutes acceptance of the new terms where permitted by applicable law.

Where required, new explicit acceptance may be requested in order to continue using all or part of the Addikme services.

18.3. Refusal of changes

If the new GTU are refused:

  • access to all or part of the Platform may be suspended or restricted
  • the account may be deactivated or terminated in accordance with these GTU

18.4. Access to the GTU

The applicable GTU are made available to Users and Creators on the Platform.


19. Force majeure

No party may be held liable for a delay or inability to perform its obligations where such non-performance results from an event meeting the conditions of force majeure provided for by applicable law.

The following may in particular be concerned where they legally constitute a case of force majeure:

  • major infrastructure failures
  • interruptions of communication networks
  • major failures of third-party providers
  • cyberattacks
  • natural disasters
  • armed conflicts, riots or acts of terrorism
  • administrative, judicial or regulatory decisions preventing performance of the service

In the event of force majeure, Addikme may temporarily or permanently suspend access to all or part of the Platform, without prior notice or compensation, and without this giving rise to any right to a refund of the amounts held in the wallet.


20. Partial invalidity

If one or more provisions of these GTU are declared void, invalid or unenforceable by a competent court:

  • the other provisions remain valid
  • the provision concerned shall, where possible, be replaced by a valid provision that comes as close as possible to its original purpose while complying with applicable law

The partial invalidity of a clause does not result in the invalidity of the GTU as a whole.


21. Applicable law and competent jurisdiction

These GTU are governed by the law applicable at the registered office of the company operating Addikme, subject to any mandatory provisions that may apply to Users.

21.1. Amicable settlement of disputes

In the event of a dispute relating to the interpretation or performance of these GTU, the parties may seek an amicable solution before taking any legal action.

21.2. Competent court

In the absence of an amicable settlement, the dispute shall fall within the jurisdiction of the competent courts in accordance with the applicable legal rules.

21.3. International use of the Platform

Users and Creators acknowledge that access to or use of certain services may be restricted or prohibited in certain jurisdictions.

They agree to comply with the laws applicable to them concerning in particular:

  • adult content
  • digital transactions
  • paid services and features offered by the Platform

Addikme implements the measures for which it is responsible concerning the operation and availability of the Platform in accordance with applicable obligations.


22. Governing version

These General Terms of Use as well as documents, policies and information pages published by Addikme may be translated into several languages in order to facilitate their understanding.

In the event of any discrepancy, inconsistency or difference in interpretation between the French version and a translation, the French version shall prevail and shall be the sole authoritative version, subject to applicable mandatory legal provisions.
